Terms of Service

These Terms of Service ("Terms") govern your access to and use of unTILTIFY ("Service"), operated by Grasp Software Paweł Wąsowski ("we", "us", "our"), a sole proprietorship registered in Poland (NIP and REGON on file).

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Service Description

unTILTIFY is a web-based trading journal application designed for prop traders. The Service helps users track trading psychology, manage evaluation and funded accounts, log daily profit and loss (PnL), and build mental discipline through guided trading sessions.

unTILTIFY is not a financial advisor, broker, or trading platform. We do not execute trades, manage funds, or provide investment advice. All trading decisions are your own responsibility.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorized use of your account.

4. Subscription Plans

The Service offers a free tier ("Wanna Be Trader") and a paid subscription ("PRO Trader"). Details of each plan are described on the Service's pricing page and within the application.

• Free Tier: Limited features including 1 active evaluation account, mental toolkit, reports, and expenses tracking.
• PRO Trader: All free features plus unlimited evaluations, funded accounts, personal accounts, income tracking, and future premium features. Priced at $4.99/month or $49.90/year.

5. Payment and Billing

• Payments are processed securely by Stripe, Inc. We do not store your credit card details.
• Subscriptions renew automatically at the end of each billing period unless cancelled.
• You may cancel your subscription at any time through your Profile settings. Cancellation takes effect at the end of the current billing period.
• Prices are in US Dollars (USD). Applicable taxes may apply depending on your jurisdiction.

6. Refund Policy

• New subscribers receive a 14-day free trial. You will not be charged during the trial period.
• If you cancel within the trial period, you will not be charged.
• After the trial, payments are non-refundable, except where required by applicable law (including EU consumer protection laws).
• If you believe a charge was made in error, contact us at support@untiltify.com within 14 days of the charge.

7. User Content and Data

• You retain ownership of all data you enter into the Service (PnL records, notes, playbook rules, etc.).
• We do not sell, share, or monetize your personal trading data.
• You grant us a limited license to store and process your data solely to provide the Service.
• You may export or delete your data at any time by contacting us or using available in-app features.

8. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to reverse-engineer, decompile, or disassemble the Service.
• Interfere with or disrupt the Service or servers.
• Create multiple accounts to circumvent free tier limitations.
• Use automated tools (bots, scrapers) to access the Service without our written permission.
• Upload malicious content or attempt to exploit security vulnerabilities.

9. Intellectual Property

The Service, including its design, code, branding, and content (excluding user data), is owned by Grasp Software Paweł Wąsowski. You may not copy, modify, distribute, or create derivative works of the Service without our written consent.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

Trading involves substantial risk of loss. unTILTIFY is a journaling and psychology tool, not a trading system. Past performance data logged in the Service does not guarantee future results. We are not responsible for any trading losses.

11. Limitation of Liability

To the maximum extent permitted by applicable law, our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

This limitation does not apply where prohibited by law, including mandatory consumer protection laws in the European Union.

12. Service Availability and Modifications

• We may modify, suspend, or discontinue the Service (or any part of it) at any time with reasonable notice.
• We may update these Terms from time to time. Material changes will be communicated via email or in-app notification.
• Continued use of the Service after changes constitutes acceptance of the updated Terms.

13. Account Termination

• You may delete your account at any time through Profile settings or by contacting us.
• We may suspend or terminate your account if you violate these Terms.
• Upon termination, your data will be deleted in accordance with our Privacy Policy.

14. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Poland. For consumers residing in the European Union, mandatory consumer protection laws of your country of residence shall apply to the extent they provide greater protection.

Any disputes shall be resolved in the competent courts of Poland, unless EU consumer law grants you the right to bring proceedings in your country of residence.
